This Privacy Notice provides information about the processing of your personal data in connection with your visit to the www.hochtief-datacenterpartner.de website and a summary of your rights under the European General Data Protection Regulation (hereinafter the “GDPR”). Personal data means any data by which you can be personally identified.

If you have any questions concerning data protection, you may contact the controller at any time using the address above and adding “Data Protection”, or by emailing dcpartner@hochtief.de.

3. Data processing when visiting the website

a) Personal data processed

When you visit our website, we collect so-called log data (hereinafter “Log Data”). This Log Data is collected automatically by our IT systems when the website is visited. It consists of a data record—also known as server log files—that we store only temporarily.

If, when visiting our website, you consent to the use of analytics and performance cookies, data relating to your use of the website will also be processed (hereinafter “Visit Data”):

When you use the contact form, we collect the data you provide in that form (hereinafter “Contact Form Data”).

b) Purpose and legal basis of processing

  • Log Data
Log Data is processed for statistical purposes and to provide our services, particularly to ensure the stability and security of the connection and the error-free delivery of the website. It therefore serves compelling legitimate grounds in the form of our legitimate interest in operating the website reliably and securely (Art. 6(1), first sentence, point (f) GDPR).
  • Visit Data
Visit Data is processed to improve the quality of our services, particularly to analyse your user behaviour, on the basis of your consent (Art. 6(1), first sentence, point (a) GDPR).
  • Contact Form Data
Contact Form Data is processed and stored solely for the purpose of responding to your enquiry or contacting you. The legal basis for processing this data is your consent pursuant to Art. 6(1), first sentence, point (a) GDPR.

c) Retention period

Unless a more specific retention period is stated in this Privacy Notice, all personal data will be erased as soon as its processing is no longer necessary for the purpose for which it was collected. Where statutory retention obligations apply, the data will be erased after the relevant retention period has expired.

d) Recipients of the data

Data is disclosed only where necessary and in the cases listed below.

  • Services for hosting and displaying the website and for making contact and communicating are provided in part by service providers acting as processors in accordance with Art. 28 GDPR. We also share Contact Form Data with HOCHTIEF PPP Solutions GmbH for storage and processing purposes, drawing on its expertise and resources to deliver our projects.
  • Your data will be disclosed to public authorities—for example, the competent data-protection supervisory authority or public prosecutor’s office—where we are subject to a legal obligation to do so. Otherwise, data will be disclosed to other recipients only where you have given us your express prior consent or where we have a legitimate interest in the disclosure.

e) Newsletters and other marketing emails; downloading documents

We send newsletters and other marketing emails where you have given your consent pursuant to Art. 6(1), first sentence, point (a) GDPR. Consent to receive our marketing emails includes analysis of your usage of and interactions with those emails—for example, open and click-through rates—so that we can provide personalised content tailored to you. If you subscribe to marketing emails or download documents made available on the website, we may associate your website visits with the personal data you have provided in order to deliver individually relevant content.

For existing customers, we may send marketing emails pursuant to Section 7(3) of the German Act Against Unfair Competition (UWG). You may object to receiving them at any time by using the unsubscribe link in the marketing email or by contacting us.

Your name and email address are required to subscribe to newsletters and other marketing mailings. Registration uses a double opt-in process. Consent may be withdrawn at any time using the unsubscribe link or by contacting us.

For evidentiary purposes, we store registrations for marketing emails pursuant to Art. 6(1), first sentence, point (f) GDPR.

4. Transfers to third countries

Among other services, we use tools from companies based in so-called third countries outside the EU or EEA. When these tools are active, your personal data may be transferred to and processed in those third countries. Please note that a level of data protection comparable to that in the EU may not always be guaranteed in these countries. When selecting tools, we ensure that an adequacy decision by the European Commission pursuant to Art. 45 GDPR or other safeguards pursuant to Art. 46 GDPR are in place. On request, we will be happy to provide a copy of the safeguards under Arts. 45 and 46 GDPR.

5. Your rights

Subject to the relevant statutory requirements, you have the following rights under the GDPR in relation to our processing of your personal data:

  • Right of access
  • Right to rectification
  • Right to erasure (right to be forgotten)

6. Consent management tool

For the purpose of managing consent for cookies and comparable technologies, we use a consent management tool (hereinafter “CMT”). When our website is accessed, a CMT cookie is set. This stores the consent granted for individual services and controls whether the respective functions are activated or deactivated.

Cookies and comparable technologies are used to analyse usage data (to keep the user logged in), store settings, provide services, track website users, monitor and analyse performance, functionality and effectiveness, track marketing campaigns, maintain security and protect against fraud, and detect and prevent cyberattacks.

The use of these cookies and comparable technologies is in our legitimate interests (Art. 6(1), first sentence, point (f) GDPR) where they are necessary to operate our website and enable its secure use.

Where cookies and comparable technologies are not strictly necessary—such as analytics and performance cookies—they are used on the website only if you have consented to them in the CMT (Art. 6(1), first sentence, point (a) GDPR). Further information about the specific cookies used is available in the CMT.

The CMT is used to obtain the required consent and document it in accordance with our accountability obligations under the GDPR and the Act on Data Protection and the Protection of Privacy in Telecommunications and Digital Services (hereinafter “TDDDG”). The legal basis for this is Art. 6(1), first sentence, point (c) GDPR. Details of the data processing carried out by the CMT are available in the tool’s user interface.
